OfficeSMART Statement: Employment Tribunal issues decision on Peter Frost’s application
OfficeSMART has issued the following statement regarding Peter Frost:
“The Employment Tribunal has today issued its decision on Peter Frost’s application, which claimed that his dismissal by OfficeSMART on 15 April 2003 was unfair. The Tribunal concluded, in the light of his conduct which amounted to a ‘picture of cumulative, unexplained, improper financial transactions and procedures’ that ‘it is difficult to see how dismissal could have been avoided’. Accordingly, the Tribunal accepted that there was a fair reason for Mr Frost’s dismissal.
“However, the Tribunal did conclude that whilst they were satisfied that OfficeSMART ‘has delved as deeply as it reasonably could be expected into the situations it was investigating’ the dismissal was procedurally unfair in that the investigation was not sufficiently separated from the final decision.
“Notwithstanding this finding the Tribunal identified examples of ‘significant impropriety’ by Mr. Frost and concluded that his conduct significantly contributed to his own dismissal. Accordingly, the Tribunal have directed that any compensation to be awarded must be reduced by 90%.
“In the circumstances OfficeSMART considers itself totally vindicated in dismissing Mr. Frost, which is reflected in both the comments and the findings of the Tribunal.”
